Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Arbor (“Arbor”, “we”, “us”), a software platform that operates automated cryptocurrency spot trading on your behalf via your own Binance account. By creating an account, connecting API keys, or paying for a subscription, you agree to these Terms.
1. What Arbor is
Arbor is software. We provide algorithmic trading strategies that operate inside your own Binance spot account using API keys you provide. We never take custody of your funds. We are not a broker, exchange, investment advisor, or fund manager.
2. Eligibility
- You must be at least 18 years old.
- You must not be in a jurisdiction where use of this service or cryptocurrency trading is prohibited.
- You are responsible for complying with your local laws, tax reporting, and regulatory obligations.
3. How the service works
3.1 Your Binance account, your funds
Trades are executed against your Binance account using API keys you encrypt and store with us. We require only Spot Trading and Read permissions. We strongly recommend you do not enable withdrawal permissions. Arbor will never ask for or need the ability to withdraw funds.
3.2 Shariah-compliance design
Arbor is designed to operate within Shariah principles for spot cryptocurrency trading: spot-market only, no leverage, no margin, no shorting, no derivatives, and no interest-bearing instruments. We maintain an exclusion list of assets we consider non-compliant (stablecoins, wrapped/pegged tokens, leveraged tokens, tokenised gold, etc.). While we make a good-faith effort, you remain responsible for confirming that the service and the specific assets it trades are compliant with your own understanding of Shariah requirements.
3.3 Automated decisions
Trading decisions are made by algorithms and machine-learning models that react to market data, news, and social signals. Arbor does not guarantee any specific outcome, win rate, or return.
4. Plans, payments, and refunds
- Subscriptions are billed monthly in EUR by Stripe. Pricing is listed on our website.
- Your bot runs for as long as your subscription is active. If payment fails, Stripe will retry for a short grace period; if it ultimately fails, your bot is automatically stopped.
- You may cancel at any time via the Stripe Customer Portal. Cancellation stops future charges and stops your bot; positions remain in your Binance account for you to manage.
- We do not offer refunds for partial months except where required by law.
5. Risk acknowledgement
Cryptocurrency trading carries substantial risk of loss, including total loss of capital. You acknowledge and accept:
- Past performance of any strategy does not predict future results.
- Market conditions, protocol exploits, exchange outages, or regulatory events can cause losses.
- Software bugs, API outages, model errors, or infrastructure failures may cause unintended trades or missed trades.
- You trade at your own risk. Only trade amounts you can afford to lose.
6. Your responsibilities
- Keep your Binance API keys scoped correctly (spot + read only, no withdrawals).
- Rotate keys if they are ever exposed. Arbor’s storage is encrypted at rest, but you must also practice good operational security on your side.
- Do not share your Arbor account. One subscription = one user.
- Handle your own tax reporting and record-keeping for trades executed via Arbor.
7. Prohibited use
You may not:
- Attempt to reverse-engineer, decompile, or extract our trading models.
- Use Arbor to manipulate markets, wash-trade, or circumvent exchange controls.
- Use Arbor on behalf of a third party without their informed consent and your own legal basis to do so.
- Use Arbor in a sanctioned jurisdiction or in violation of export-control law.
8. Intellectual property
All software, models, designs, and content are the property of Arbor and its licensors. You receive a personal, revocable, non-exclusive, non-transferable licence to use the service for your own trading purposes while your subscription is active.
9. Disclaimers
The service is provided “as is” and “as available”, without warranties of any kind (express or implied), including merchantability, fitness for a particular purpose, non-infringement, or that the service will be error-free or uninterrupted. Arbor is not an investment advisor. Nothing on the platform constitutes financial, legal, or tax advice.
10. Limitation of liability
To the maximum extent permitted by law, Arbor’s total liability for any claim arising out of or related to these Terms is limited to the amount you paid us in the twelve months preceding the claim. We are not liable for trading losses, lost profits, indirect, consequential, special, incidental, or punitive damages, even if advised of the possibility of such damages.
11. Termination
You may terminate your account at any time by cancelling your subscription and deleting your API keys. We may suspend or terminate your account for violations of these Terms, fraud, or legal requirement. On termination, your bot is stopped and your data is retained or deleted in accordance with our Privacy Policy.
12. Changes to these Terms
We may update these Terms from time to time. Material changes will be announced by email and on the platform. Continued use after an update constitutes acceptance of the updated Terms.
13. Governing law
These Terms are governed by the laws of Austria. Disputes will be resolved in the competent courts of Vienna, Austria, unless mandatory consumer-protection law requires otherwise.
